Our Legal Approach

Land Acquisition Strategy

In October 2022, we worked with the client to develop a legal strategy for acquiring long-term lease rights for farmland. Given that foreign entities cannot directly own land in China, we structured the acquisition as a long-term lease agreement with local authorities under China’s Land Administration Law. We assisted the client in identifying prime agricultural land in a province known for high crop yields and favorable farming conditions. We conducted due diligence to ensure that the land was properly zoned for agricultural use and free from any legal encumbrances. By November 2022, we helped the client negotiate a 30-year lease agreement with local government authorities, securing favorable terms for rent, land development, and agricultural production.

Agricultural Regulatory Compliance

We advised the client on compliance with Chinese laws related to the importation of seeds, pesticides, and fertilizers, ensuring that all imported agricultural inputs met local standards set by the Ministry of Agriculture and Rural Affairs (MARA). In November 2022, we helped the client navigate the Seed Law of China, ensuring that the seeds imported for production were properly registered and certified by Chinese authorities.
